Terms and Conditions of Sale – Vista MTP

Introduction
Vista MTP is a French company with a share capital of €1,000, registered under number 94521951700014, with its registered office at 976 Avenue Raymond Dugrand, 34000 Montpellier, France. It operates the website www.vistafootballshop.com, through which football-related products are offered for sale.
These Terms and Conditions of Sale (hereinafter the “Terms”) govern all sales made through this website, both in France and internationally.
Scope
The Terms define the rights and obligations of the parties in the context of the sale of products offered by Vista MTP on its website www.vistafootballshop.com.
Any order placed implies full and unconditional acceptance of these Terms by the customer.
Vista MTP reserves the right to amend the Terms at any time. The applicable version is the one in force at the time of the order.
Customer Identification
Sales are reserved for individuals of legal age acting in a personal capacity.
To place an order, the customer must provide complete and accurate information via a form (name, surname, address, phone number, email, etc.).
These details are required to process the order. Vista MTP shall not be held liable for errors or delays caused by incorrect or incomplete information.

Order
Each order is subject to a summary (products, prices, quantities, shipping costs) which the customer may modify before final validation. Once the order is confirmed, a confirmation email will be sent.
Vista MTP reserves the right to refuse any order not compliant with these Terms.
Prices
Prices are expressed in euros, including all taxes (VAT included). Shipping costs are added prior to the final confirmation of the order. An invoice will be sent upon delivery.
Availability
Products are offered within the limits of available stock. If a product becomes unavailable after the order is placed, Vista MTP will offer an exchange or a refund within 14 days.
Payment
Payment is made online via secure bank card processing. Vista MTP does not store any banking information.
If payment is refused, the order will be cancelled.
Delivery
Delivery is available in France and in the countries listed on the website. Delivery times typically range between 2 to 10 business days after shipment.
Products are delivered to the address provided by the customer. Vista MTP shall not be held liable for delays or delivery errors caused by an incorrect address.
In the event of non-delivery, Vista MTP will provide the necessary tracking information and carrier contact details, but liability for the package transfers to the customer upon shipment.
Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code:
“The consumer has a period of fourteen days to exercise their right of withdrawal from a distance contract, without having to provide any reason or bear costs other than those provided for in Articles L. 221-23 to L. 221-25.”
Returns must be made in their original condition to the following address, at the customer's expense:

Vista MTP will issue a refund within 14 days from receipt of the returned products. Any item returned incomplete or damaged will not be fully refunded.
Non-conformity and Legal Warranties
In case of non-conformity of the delivered product, Vista MTP agrees to replace or refund the product.
Products are covered by the following legal warranties:
Article L.217-4 of the Consumer Code
“The seller delivers a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
They are also liable for any lack of conformity resulting from packaging, installation instructions, or installation when it is part of the contract or carried out under their responsibility.”
Article L.217-5 of the Consumer Code
“The good is in conformity with the contract:
1° If it is suitable for the usual purpose of a similar good and, where applicable:
– matches the description given by the seller and has the qualities presented to the buyer in the form of a sample or model;
– has the qualities a buyer may legitimately expect based on public statements made by the seller, manufacturer, or representative, particularly in advertising or labeling;
2° Or if it has the characteristics agreed upon by both parties or is suitable for a specific purpose made known to the seller and accepted by them.”
Article L.217-12 of the Consumer Code
“The action resulting from a lack of conformity shall be time-barred after two years from the date of delivery.”
Article L.217-16 of the Consumer Code
“When the buyer requests, during the course of a commercial guarantee granted upon the purchase or repair of movable property, a repair covered by the guarantee, any period of immobilisation of at least seven days shall be added to the remaining duration of the guarantee.”
Article 1641 of the Civil Code
“The seller is liable for hidden defects in the item sold which render it unfit for its intended use, or which so diminish its use that the buyer would not have acquired it, or would have paid a lower price, had they known of them.”
Article 1648 paragraph 1 of the Civil Code
“The action resulting from latent defects must be brought by the buyer within two years from the discovery of the defect.”
Force Majeure
Vista MTP shall not be held liable in the event of force majeure preventing performance of the contract. The customer will be informed within 7 days.
If the force majeure event lasts more than 15 days, the order may be canceled and refunded.
No Waiver
The fact that Vista MTP does not immediately exercise one of the clauses herein does not constitute a waiver of the right to do so at a later date.
Validity of the Terms
If one clause of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Applicable Law
These Terms are governed by French law, subject to the mandatory provisions of EU Regulation No. 593/2008 of 17 June 2008 (Rome I).
